An update from the FCA – How to recruit, change or terminate an appointed representative.

When authorizing appointed representatives (ARs) to conduct regulated activities on behalf of your firm, their actions, or inactions, are attributed to your organization. It is imperative to ensure that the appointed ARs can be adequately supervised and adhere to our standards.

You are also accountable for verifying the fitness and propriety of individuals seeking our approval within the AR framework, ensuring compliance with our regulatory requirements. The appointment of an AR may necessitate the submission of an Approved Person application associated with your AR notification.

The FCA anticipate receiving notifications and applications of superior quality, demonstrating a clear understanding of your responsibilities and the implementation of suitable systems and controls.

As part of heightened scrutiny during the application process, both AR notifications and the corresponding Approved Persons applications are jointly assessed at the gateway.

To bring a new AR on board, notify the FCA by completing the ‘add an appointed representative or tied agent’ form on Connect, ensuring submission at least 30 calendar days before the AR appointment commencement
